„Silk Go” Terms of Service

1. Service General Description

  • 1.1. “Silk Go” is designed for adult private persons, this service (hereinafter referred to as “Service”) can be used at any location (both in Georgia and abroad) where you (private person user) have internet connection (both fixed and wireless).
  • 1.2. “Service” includes a part of certain functional and content of “Silk TV”. Besides, “Service” content and access to it differs in case of use/access from Georgia and from foreign countries.
  • 1.3. In order to purchase the paid package of the “Service” (hereinafter referred to as “paid package”) you (user) have to complete registration and authorization as defined by the present rules. Besides, in certain areas you (user) have the possibility to watch certain non-commercial content (such content as is accessible for the user in the internet space without additional payment) defined by “Silknet” (should such content exist) without registration and authorization via mob app and website www.silktv.ge. Besides, alongside with the abovementioned, after registration/ authorization, in certain areas you have the possibility to watch other content too (should such exist) in trial mode during a certain period.
  • 1.4. The service offers Silk TV functionality and content access across various operating systems and devices, including Apple iOS, Google Android, PC clients, and Smart TVs.
  • 1.5. You (user) can receive “Service” via the following operative systems/devices:
    • 1.5.1. Ony type of personal computer (desktop, laptop);
    • 1.5.2. On mobile phones and tablets (Google Android 5.0 / API level 21 and all subsequent versions and Apple iOS (iPhone, iPad) 13.4 and subsequent versions ;
    • 1.5.3. Smart TV:
      Samsung: Operating system Tizen 3.0 or higher (specifically on Basic, Standard, and Premium class models released since 2017; the application on the APP Store is available only for the Georgian region)
      LG Smart TV: Operating system WEB OS 3.0 or higher
      Android TV: From Android 5.0 version (API Level 21) and above (specifically on TVs from Sony, TCL, Hisense, Philips, Toshiba, and other certified manufacturers)
  • 1.6. In the process of “Service” utilization the following options/properties of the abovementioned operative systems/devices are used: memory, internet connection, battery power, etc. Based on the abovementioned, we (“Silknet”) do not bear any responsibility for such “Service” insufficiencies and/or obstacles/connection breaks which depend on the options/properties of the operative systems/devices described above.
  • 1.7. The Silk TV application can be used with any provider's internet connection, whether via a LAN cable or WiFi

2. General Terms/Rules for Registration/Purchase/Authorization of the “Service”/“Paid Package”

  • 2.1. Registration for the purchase of the “paid package” is possible via the following:
    – Website: www.silktv.ge, Apple App Store, Google Play Store, corresponding channel, “Service”
    application is presented under the name of “Silk GO”.
  • 2.2. You can complete registration after downloading the “Service” app and/or upon visiting the website www.silktv.ge with the help of the same device through which “Service” app was downloaded/website www.silktv.ge visited. Completion of registration/app download is free. Besides, “Service” app can be downloaded for one as well as for several devices (number of devices is not limited). Registration is also possible on Smart TVs—remotely—after downloading the 'Silk Go' application on the TV. Users can register using a mobile phone via QR code or through the website at http://silktv.ge/register.
  • 2.3. The subscriber must be an adult, to register for this service;
  • 2.4. It is only possible to complete one registration/register one account number with one mobile number.
  • 2.5. Authorization with the same username and password on the website and/or application on a mobile device is unlimited, though only two simultaneous watching of the “paid package” content are possible with the same username and password. In case of attempt of a third simultaneous watching, the user will enjoy the same rights as an unregistered subscriber (i.e. only non-commercial content, should such exist).
  • 2.6. The application can be installed on both mobile and TV devices without any limitations.
  • 2.7. It is impossible to temporarily pause the “paid package”. Deactivation (cancelation) of the “paid package” is possible at any time.
  • 2.8. Purchase of the second and each following “paid package” by you (subscriber) does not automatically cancel/deactivate previously purchased paid packages (if the newly purchased “paid package” does not envisage otherwise) and correspondingly, does not cancel subscription payments for the abovementioned (previous “paid package”).
  • 2.9. Regardless of area (does not matter where you are located), you can purchase any “paid package”, while through authorization/website access you (user) can only watch those purchased “paid packages”/trial mode content that is distributed in the area where you are located for the moment of authorization/access.
  • 2.10. Payment of monthly subscription for “paid package” is possible via the “Silknet” account number (identification used for payment is “Silknet” account).
  • 2.11. If you (user) the Premium Georgia package and use the Silk Go app with the mobile number you specified during registration, your mobile data will not be charged. Otherwise, the regular rate will apply and be taken from either the balance linked to the number or the remaining data in your activated data package. The service usage while using the application is included in the price of the "Premium Georgia" package within the "Geocell" mobile Internet tariff. When using different devices, if the user accesses the Silk Go application ("Premium Georgia" package) using a Geocell mobile number that is not registered during Silk Go registration, the standard Internet rate will be applied for the data used while using the application. This will be handled in one of the following ways: 1.The service cost will be deducted from the corresponding balance of the Geocell number or 2.The service cost will be deducted from the data volume of the active Internet package on this number.
  • 2.12. When using the "Premium Georgia" package, the cost of mobile Internet traffic will not be charged to subscribers of the following Geocell Rate Plans: Geocell 01, Geocell 10, SME, Lai Lai, Geocell Staff, and Geocell Test (For other Rate Plans, the conditions specified in clause 2.11. will not apply).
  • 2.13. After registration/authorization in the Smart TV application, the "Basic Georgia" package is automatically activated for the subscriber. When attempting to watch paid channels and content, the system will prompt the subscriber to activate the corresponding "Full Package" package.

3. Terms of Service / Paid Package

For subscribers of "Silknet" registered until November 9, 2021

  • 3.1. When connecting the "service" to an existing account, the subscriber uses the Pre Pay system.
  • 3.2. If you purchase a "paid package" during the assignment of a temporary account number and your existing "Silknet" account has an outstanding debt, your services will be limited. The subscriber will not be able to use the "paid package" purchased with the "Silk Go" service until the debt on the existing "Silknet" account is paid off. The use/activation of the "paid package" on the same "Silknet" account will be restricted until the numerical debt is settled.
  • 3.3. The monthly cost of using the "paid package" is billed according to the terms of the subscription account to which the "service" is linked (Post Pay). Accordingly, in case of non-payment of the debt, the restriction and recovery conditions of the subscription account to which the service is linked will apply.
  • 3.4. In case of cancellation of registration/account by the subscriber, both the positive and negative balances calculated for the same service will remain in the subscription account to which the "service" was linked.

4. Terms/Rules of Registration/“Service”/“Paid Package” Purchase/Authorization

for Non-Existing “Silknet” Subscribers

  • 4.1. During registration you will automatically be assigned a new “Silknet” subscriber account number.
  • 4.2. Your monthly payment for “paid package” is performed on the pre-pay principle. Correspondingly, if there is no positive balance on the account, you will not be able to purchase the paid package/“paid package” will be limited (switched off).
  • 4.3. If during 6 (six) calendar months after the registration you do not add money to your account, registration will be canceled, which automatically implies cancellation of the account.
  • 4.4. In case you cancel registration/account, positive balance of this service (should such exist) will be returned to you according to Silknet rules, see website: www.silknet.com.

5. Other Provisions

  • 5.1. “Silknet” retains the right to update the system (application), add/reduce functional, change design and structure at its discretion at any time without prior notification to you (user).
  • 5.2. “Silknet” has the right to stop/cancel and/or suspend “service” (provision of “paid package”) without prior notification of the “subscriber” in case:
    • 5.2.1. You (subscriber) violate the present rules/terms;
    • 5.2.2. There is a doubt that an unauthorized person uses the “Service” app and/or you use the “Service” app (“paid package”)/trial mode content/non-commercial content for activities prohibited by the law.
  • 5.3. Use of “Service” app/app utilization/access to app/use of “paid package”/watching trial mode/non-commercial content is possible/allowed only observing the present rules/within the present rules. Accordingly, use of “paid package” “Service” app/trial mode content and/or access to the abovementioned with violence of the present rules (performing any action not directly envisaged by the present rules/terms, as well as performing any action prohibited by the present rules/terms) will be considered as unsanctioned/illegal use/access, and “Silknet” retains the right to suspend/cancel “Service”/“paid package”/trial mode content, as well as perform other reaction envisaged by the legislation.
  • 5.4. “Silknet” bears no responsibility for the cases when you (“user”) share incorrect or incomplete information during registration (address, email, phone, etc.). You bear full responsibility for all outcomes resulting from the abovementioned.
  • 5.5. You (user) are obliged to prevent engagement of “Service”/“Service” application/“paid package” in international or other unsanctioned transfer of paid traffic and/or activities and schemes performed with the aim of a fraud, as well as protect any equipment and/or technical device in your possession/use, linked to “Silknet” network, against any unpermitted penetration and use. You (subscriber) unconditionally accept any liability and/or incurred damage to “Silknet” caused by the abovementioned actions.
  • 5.6. When reviewing argument concerning traffic and/or “paid package” payment, only records presented by Silknet will be taken into consideration if not defined otherwise by the regulating body/court.
    Note:
    Fraud: receiving “Service” free of charge and/or for reduced price by way of avoiding paying “Service Cost” defined for the “Service”;
    Traffic: unity of transferred data (signals, messages, packages, etc.) in a given period of time through a communication system.
  • 5.7. “Silknet” is authorized to immediately limit your “Service”/“paid package” if suspicion arises that “Service”/paid package provided to you is used with the aim of “fraud” or is connected to a “fraud”.
  • 5.8. Rates for use of “paid package” are listed at the website www.silktv.ge
  • 5.9. Completion of registration means that you (subscriber) automatically agree to the present rules/terms.
  • 5.10. “Silknet” retains the right to enter amendments to the present rules/terms at any time with publishing them at the website www.silktv.ge, which automatically implies that you (user) agree to the abovementioned terms.

6. Fee for Post Pay System Services:

  • 6.1. Starting from October 1, 2014, a Post Pay system subscriber who fails to pay the value of the accounting month services within the period established by the contract will be charged a fine. The fine amount is determined as 20% of the unpaid portion of the total amount of the subscription and talk minutes charged for the services on one account, but not exceeding one GEL per service. The fine will not be charged if the unpaid portion of the total amount for the services on one account does not exceed the number of services multiplied by 0.10 GEL. The penalty will be charged after the expiry of the last day of the corresponding payment period. Multiple similar services on one account are considered as separate services.
